PowerDog helps customers make better use of their home-energy equipment.
The PowerDog Optimiser uses information about your electricity tariff, household energy usage, solar generation, battery and connected equipment to create and apply charging and discharging schedules. Its purpose is to help reduce electricity costs and make more effective use of electricity generated or stored at your property.
To provide this service, PowerDog may need permission to read information from your connected equipment and, where supported, change certain equipment settings automatically.
PowerDog is designed to operate within the preferences and limits you provide and the controls made available by the manufacturer of your equipment via your personal API key or other such authentication method. However, energy use is affected by many matters outside our control. These include your household consumption, weather, solar generation, electricity prices, tariff rules, equipment performance, internet availability and third-party systems.
PowerDog cannot guarantee that the Optimiser will always produce a saving, identify the cheapest possible schedule or operate without interruption.
These Terms explain:
Please read these Terms before creating an account or connecting any equipment.
PowerDog is a trading name of Codetermine Ltd, a company registered in England and Wales under company number 16502785, whose registered office is at Unit 9, Langley Business Park, Bill King Way, Langley, Macclesfield, SK11 0AZ, United Kingdom. In these Terms:
refer to Codetermine Ltd trading as PowerDog.
These Terms form a legally binding agreement between PowerDog and the person who creates or uses a PowerDog Account.
In these Terms, “you” and “your” refer to that person.
By creating an Account, connecting equipment, purchasing a subscription or using the Optimiser, you confirm that:
You must not use the Service if you do not agree to these Terms.
These Terms are intended primarily for people using PowerDog for their own household and not mainly for business purposes.
Nothing in these Terms affects any rights that cannot lawfully be excluded or restricted, including your statutory rights under the Consumer Rights Act 2015.
Different terms may apply where PowerDog is provided through a landlord, housing provider, installer, energy supplier or other business partner.
In these Terms:
Account means the PowerDog account created for you.
Connected Equipment means any compatible battery, inverter, solar-generation system, electric vehicle charger, heating equipment, meter, gateway or other energy-related equipment connected to the Service.
Device Data means information generated by or relating to Connected Equipment, including operating status, energy flows, charge level, power, settings, availability, charging and discharging activity and fault information.
Energy Data means information relating to electricity consumption, import, export, storage or generation at the Property.
Optimisation means the process by which PowerDog analyses available information and determines proposed operating schedules or settings.
Optimiser means the PowerDog software service that monitors, schedules or controls supported Connected Equipment for the purpose of managing household energy use.
Preferences means the limits, objectives or instructions you provide, such as minimum battery charge, charging deadlines, operating modes or other available settings.
Property means the home or other premises at which the Connected Equipment is installed.
Service means the PowerDog website, application, platform, Optimiser, software, support services and related functionality made available under these Terms.
Subscription means any paid plan under which you receive access to the Service.
Third-Party Service means a service operated by another organisation on which PowerDog or your Connected Equipment depends, including manufacturer platforms, cloud services, tariff-data services and communications providers.
The Optimiser is designed to help manage the timing of electricity usage, battery charging and battery discharging.
Depending on your equipment, tariff and chosen settings, the Optimiser may:
Not every feature will be available for every device, tariff or customer.
The Service covered by these Terms is limited to the PowerDog Optimiser.
These Terms do not enrol you or your Connected Equipment in:
PowerDog will not use your equipment for those purposes under these Terms.
If PowerDog introduces a separate flexibility or grid-service offering in the future, participation will require separate information, permissions and applicable terms. It will not be introduced merely by updating an Optimiser schedule without informing you.
PowerDog does not supply electricity and does not replace your energy supplier.
Your electricity supply contract, tariff, standing charges, export arrangements and billing remain between you and your relevant provider.
PowerDog does not control:
The Service is intended to assist with normal energy management. It is not designed as:
The Optimiser may use information including:
Some information may be estimated, delayed or supplied by third parties.
The Service may show predicted:
These are estimates rather than guarantees.
Actual results may differ because of matters including:
Where you enable automatic Optimisation, you authorise PowerDog to send supported instructions to your Connected Equipment.
Those instructions may change:
PowerDog will seek to operate in accordance with your available Preferences. However, the exact controls available depend on the manufacturer and model of your equipment.
You are responsible for reviewing and selecting appropriate Preferences.
You should take particular care when choosing:
These settings are governed by software, hardware or firmware that is provided by the OEM, and may have been defined by installer under advisement or to comply with requirements laid out by NESO or your electricity network operator.
You may be able to alter your equipment through:
Changes made outside PowerDog may conflict with or override the Optimiser. Similarly, the Optimiser may subsequently update a setting that you changed elsewhere if automatic Optimisation remains enabled.
You should avoid using multiple automatic control services simultaneously unless they are expressly designed to work together.
We are not responsible for unexpected behaviour caused by conflicting commands, settings or control systems outside PowerDog’s reasonable control.
By connecting equipment and enabling the Optimiser, you authorise PowerDog and the suppliers we use to deliver the Service to:
This permission continues until:
Some data may continue to be retained after disconnection where reasonably required for legal, security, accounting, support or dispute-resolution purposes, as explained in our Privacy Notice.
The Service works only with equipment, firmware and manufacturer services that PowerDog supports. Compatibility may depend on:
A device being listed as supported does not mean every feature or configuration of that device will be available.
You must ensure that Connected Equipment:
PowerDog does not inspect or certify your physical installation.
Connecting equipment to the Service does not mean that PowerDog has approved:
The operation of your equipment remains subject to its own:
Where there is a conflict between an instruction from PowerDog and a safety limit imposed by the equipment, the equipment’s safety control should take precedence.
You must tell us, or update your Account, where relevant equipment is:
You must disconnect the equipment from your Account before moving out of the Property or transferring control of it to someone else.
You must provide information that is accurate, complete and current.
This includes information about:
You must update the information if it changes.
You are responsible for taking reasonable steps to protect your Account.
You must:
You are responsible for activity carried out through your Account unless it results from PowerDog’s failure to use reasonable care and skill or from circumstances for which the law makes us responsible.
You must have permission to connect and control the relevant equipment.
Where the Property or equipment is jointly owned, rented or managed by another person, you are responsible for obtaining any permission reasonably required from:
You must not connect equipment that you do not have authority to manage.
We may permit additional users or members of a household to access some features.
The primary Account holder is responsible for ensuring that authorised users understand these Terms and use the Service appropriately.
You must not provide access to anyone who may use the Service unlawfully or without the permission of the person responsible for the Property.
You agree to:
You must not:
We may take reasonable action to protect PowerDog, customers, Connected Equipment and third parties where we suspect misuse.
We aim to provide a reliable Service, but continuous or uninterrupted availability is not guaranteed.
The Service may be affected by:
We may temporarily suspend all or part of the Service for:
Where reasonably practicable, we will provide notice of planned interruptions likely to have a material effect.
We may update or change the Service to:
Where a change materially reduces a core feature you have paid for, we will provide reasonable notice where practicable and explain any right you may have to cancel.
Connected Equipment and integrations may depend on services supplied by manufacturers and other third parties.
A third party may:
The Optimiser is intended to help reduce electricity costs, but savings are not guaranteed.
The amount saved, if any, will depend on circumstances including:
Any comparison, estimated saving or projected benefit shown by PowerDog is illustrative unless expressly stated otherwise.
Comparisons may rely on assumptions about what would have occurred without the Optimiser. They may not match your supplier’s billing methodology.
Charging and discharging a battery involves conversion losses and may contribute to normal battery wear.
PowerDog may take battery characteristics into account where relevant information is available, but it does not manufacture or warrant the battery.
You are responsible for reviewing:
Access to some or all of the Service may require a Subscription.
Before you subscribe, we will tell you:
The specific information shown when you subscribe forms part of your agreement with us.
You authorise our payment provider and us to collect the applicable charges using your chosen payment method.
You must keep payment details current and ensure that you are authorised to use the payment method.
If payment fails, we may:
We will not intentionally prevent you from safely disconnecting equipment merely because a payment has failed.
We may change Subscription prices. We will provide reasonable advance notice before a price increase applies to an existing renewing Subscription.
Where you do not accept the change, you may cancel before the new price takes effect.
PowerDog may offer the Service:
We will explain any applicable limits and what happens at the end of a trial or introductory period before taking payment.
Beta features may be less reliable, may change more frequently and may be withdrawn. This does not remove our obligation to use reasonable care and skill.
You may cancel your Subscription using the cancel option within the PowerDog app at any time.
Unless we tell you otherwise when you subscribe:
This does not affect any legal right to a refund.
Where consumer cancellation rights apply, you may have a legal right to cancel within 14 days of entering into a paid contract.
If you ask us to begin providing the Service during that period, the consequences of cancellation will be explained during signup.
Nothing in these Terms removes any cancellation right provided by law.
Cancelling a Subscription does not necessarily disconnect every Third-Party Service immediately. You should follow the instructions in your Account to:
We will take reasonable steps to stop sending Optimiser instructions once the relevant connection is disabled.
You may stop using the Service and close your Account at any time.
Closing your Account will end these Terms, subject to provisions intended to continue afterwards.
We may temporarily suspend all or part of the Service where reasonably necessary because:
Where appropriate, we will explain the reason and provide a reasonable opportunity to resolve the issue.
We may act without advance notice where immediate action is reasonably needed to protect safety, security or the integrity of the Service.
We may end this agreement where:
Where the reason is not your breach, we will aim to provide reasonable notice.
When the agreement ends:
Ending the Service does not physically remove or reset your equipment.
PowerDog helps households understand and optimise how they use, store and generate energy.
To provide that service, we may process information relating to your Account, Connected Equipment, electricity usage, tariff and use of the PowerDog platform.
Much of this information is technical. However, when viewed over time, energy information can also provide useful insights into how a home operates. That is what makes the Optimiser valuable, but it is also why the information deserves careful handling.
We believe customers should be able to benefit from smart-energy technology without unnecessarily compromising their privacy or losing control over their information.
A single electricity reading usually reveals very little. Patterns of information can be more useful.
For example, Energy Data may help identify:
PowerDog uses these insights to provide and improve the Service.
We also recognise that information relating to a home is personal. We therefore treat Energy Data and Device Data carefully, even where individual readings may not initially appear sensitive.
As with any online service, PowerDog must take reasonable steps to protect customer accounts and information from unauthorised access, loss or misuse.
This includes reducing the risk of:
These risks are not unique to PowerDog, and most customers will never encounter them. Nevertheless, a responsible service should consider privacy and security before problems arise.
Where you authorise PowerDog to interact with Connected Equipment, we aim to ensure that:
PowerDog does not replace the safety protections built into equipment or provided by manufacturers and installers. Our role is to operate within those protections.
PowerDog seeks to apply the following principles:
Data protection is not only about confidentiality.
The Service also depends on information being:
Incomplete or inaccurate information may affect reports, schedules, estimates and Optimisation decisions. We therefore seek to maintain proportionate safeguards and records appropriate to the Service.
PowerDog may receive detailed information about how energy moves through your home and may, where you authorise us, adjust supported settings on Connected Equipment.
We recognise that this is a position of trust.
We aim to earn that trust by:
Our Privacy Notice provides more detailed information about the personal data we collect, our lawful bases, recipients, retention, international transfers and your legal rights.
PowerDog will process personal data in accordance with:
Depending on the features you use, we may process:
The precise categories and purposes are described in our Privacy Notice.
To provide the Service, we may need to exchange information with organisations including:
We seek to share only information reasonably required for the relevant purpose and to use appropriate contractual or other safeguards.
PowerDog does not sell identifiable household Energy Data or Device Data to data brokers or advertisers.
We will not permit an advertising business to use detailed identifiable household-energy information to build an advertising profile about you.
This does not prevent PowerDog from:
We may send messages reasonably required to provide and administer the Service, including:
These are service communications rather than marketing.
Marketing communications will be handled separately in accordance with applicable law and the choices available to you.
If a security or personal-data incident occurs, we will take reasonable steps to:
PowerDog and its licensors own the intellectual-property rights in the Service, including relevant:
While these Terms remain in effect, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for its intended household purpose.
This permission does not transfer ownership of any PowerDog intellectual property to you.
You retain ownership of information you provide to PowerDog.
You give us permission to host, process, analyse and use that information to:
Where we create properly anonymised or aggregated information that no longer identifies you, we may use it for purposes including service analysis, product development and research.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
This includes liability for:
We will provide the Service using reasonable care and skill.
If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill.
Loss is foreseeable where it is obvious that it may happen or where, when the contract was made, both you and PowerDog knew that it might happen.
We are not responsible for loss caused solely by:
This does not apply where PowerDog caused or materially contributed to the loss through a breach of contract or failure to use reasonable care and skill.
We are not responsible for:
This does not prevent you from claiming for a direct and foreseeable financial loss caused by our breach where the law entitles you to do so.
We do not accept responsibility merely because equipment experiences normal degradation, wear, conversion loss or failure while connected to PowerDog.
However, we do not exclude responsibility for foreseeable damage directly caused by PowerDog failing to use reasonable care and skill.
The consumer Service is supplied for private household use.
If you use it for a commercial purpose, we will not be responsible for:
Our total liability to you for all claims arising out of or in connection with the Subscription and these terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of £500 and the total Subscription fees you paid to us in the 12 months before the event giving rise to the claim.
Any financial cap will not apply to liabilities that cannot legally be limited and must not prevent you from receiving the remedies required by consumer law.

Nothing in this section restricts your right to seek other remedies available under law.
We may update these Terms to reflect:
Minor changes may take effect when published.
Where a change materially affects your rights or the core Service, we will provide reasonable advance notice by email, through the Service or by another appropriate method.
Where required by law, we will ask for renewed acceptance. If you do not accept a material change, you may stop using the Service and cancel your Subscription before the change takes effect.
You may not transfer your rights or obligations under these Terms to another person without our written agreement.
We may transfer our rights and obligations to:
We will only do so where the transfer does not reduce your legal rights. We will notify you where required.
Neither party is responsible for delay or failure caused by events beyond its reasonable control.
These may include:
PowerDog will take reasonable steps to reduce the effect of such an event and restore the Service.
If the event materially prevents provision of a paid Service for a prolonged period, you may have the right to cancel.
These Terms, the information presented when you subscribe and any terms expressly incorporated into them form the agreement between you and PowerDog concerning the Service. Nothing in this section excludes liability for fraud or prevents you from relying on statements that form part of your consumer contract under applicable law.
If either party delays enforcing a right, that does not mean the right has been waived.
If a court finds that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply.
Unless these Terms expressly say otherwise, a person who is not a party to this agreement does not have a right to enforce it under the Contracts (Rights of Third Parties) Act 1999.

PowerDog may also bring proceedings in the courts applicable under consumer law.
